These Terms and Conditions work in conjunction with our Privacy Policy.

Your Key Rights and Responsibilities

This is a brief summary of our terms. Please read the full document carefully.

  1. You are responsible for food safety. Our recipes are generated by AI and may contain errors. You must verify all cooking steps, especially temperatures for meat and allergen information.
  2. You cook at your own risk. We are not liable for any food-related injuries, illnesses, allergic reactions, or kitchen accidents.
  3. Recipes are our intellectual property. You are granted a license for personal, non-commercial use only. Using our recipes in a restaurant, blog, or cookbook requires a separate commercial license.
  4. Monthly subscriptions are non-refundable. Annual subscriptions are refundable within 14 days of purchase, minus one month's rate. See Section 8.4 for full details.
  5. Disputes will be resolved by arbitration. By using the service, you waive your right to a jury trial and to participate in a class-action lawsuit.

The most critical sections for your safety and legal rights are Section 3 (AI-Generated Content, Recipe Liability & Food Safety) and Section 4 (Limitation of Liability). Please read them with extra care.

1. Introduction & Acceptance of Terms

Welcome to CulinaryAdvisor.ai (the "Service"), an AI-powered culinary mentorship platform operated by Sapient Technology Group LLC ("Company," "we," "us," or "our"). Our Service uses a unique Kitchen Brigade architecture to provide personalized recipe generation, real-time cooking guidance, and expert troubleshooting.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the Company. By accessing our website, creating an account, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our integrated Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service.

The Service is intended for users who are at least 13 years of age. If you are between the ages of 13 and 17, you may only use the Service with the consent and under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Definitions

  • "Service" refers to the CulinaryAdvisor.ai platform, including our website, AI chat interfaces, recipe generation systems, recipe execution mode, Personal Culinary Library, and all related features and content.
  • "User," "You," or "Your" refers to any individual who accesses or uses the Service.
  • "Company," "We," "Us," or "Our" refers to Sapient Technology Group LLC.
  • "Kitchen Brigade" refers to our proprietary multi-specialist AI architecture that generates and refines Recipes.
  • "Recipe" refers to any AI-generated culinary instructions provided by the Service, including ingredient lists, measurements, step-by-step directions, timing, nutritional information, and any related guidance.
  • "Content" refers to all Recipes, text, data, AI-generated images, and information generated or made available through the Service.
  • "Personal Culinary Library" or "Recipe Library" refers to the feature that allows a User to save, store, and organize Recipes within their Account for personal use.
  • "Account" refers to a User's registered profile that enables access to the Service.
  • "Personal Use" refers to non-commercial use of the Service and its Content for your own cooking, or for sharing with family and friends in a private, non-commercial setting. It expressly excludes any activity intended for commercial gain, such as use in a restaurant, catering business, monetized blog, or published cookbook.
  • "Beta Features" refers to features marked as "Beta," "Preview," or "Experimental" that are provided for testing and feedback purposes.

3. AI-Generated Content, Recipe Liability & Food Safety

⚠️ THIS SECTION CONTAINS CRITICAL WARNINGS REGARDING YOUR SAFETY. PLEASE READ IT CAREFULLY. BY USING THE SERVICE, YOU ACKNOWLEDGE AND ACCEPT THESE RISKS.

3.1 Nature of AI-Generated Recipes

ALL RECIPES ARE GENERATED BY ARTIFICIAL INTELLIGENCE AND HAVE NOT BEEN TESTED BY HUMANS. The Service uses our proprietary Kitchen Brigade, a multi-specialist AI architecture, to generate Recipes. While designed to be high-quality, this Content is created by an automated system and may contain errors, inaccuracies, omissions, or unsafe instructions. Erik Benjamins, the founder, designed the system architecture but does not personally review, test, or approve individual Recipes generated by the Service.

3.2 Your Absolute Responsibility for Verification

YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR VERIFYING ALL INFORMATION AND INSTRUCTIONS PROVIDED IN ANY RECIPE BEFORE AND DURING USE. You must apply common sense, judgment, and your own knowledge to every step. This includes, but is not limited to, verifying:

  • Food Safety Temperatures: ALWAYS cross-reference safe minimum internal cooking temperatures with authoritative sources like the USDA or your local health authority, especially for meat, poultry, seafood, and eggs.
  • Allergens: DO NOT RELY ON THE AI FOR ALLERGEN INFORMATION. If you have a food allergy, you must independently verify every ingredient and be aware of potential cross-contamination in your own kitchen.
  • Ingredient Suitability: Ensure all ingredients are safe for consumption and appropriate for your dietary needs.
  • Technique & Equipment Safety: Use all kitchen equipment (knives, appliances, etc.) safely and according to manufacturer instructions.
  • Recipe Modifications: If you modify a Recipe in any way (e.g., substitute an ingredient, alter a cooking time or temperature), you are taking full and sole responsibility for the outcome of that modification.

3.3 Food Safety & Health Disclaimers

YOU ASSUME ALL RISK OF FOOD-RELATED ILLNESS OR INJURY. The Service is not a substitute for professional culinary or food safety training. We are not liable for any foodborne illness, allergic reactions, or adverse health consequences that may result from using Recipes from the Service. Users with health conditions, compromised immune systems, or other dietary restrictions must consult a qualified healthcare professional. The nutritional information provided is an AI-generated estimate and may be inaccurate.

3.4 Kitchen Safety & Recipe Success Disclaimer

YOU ASSUME ALL RISK OF KITCHEN ACCIDENTS AND FAILED RECIPES. Cooking involves inherent risks, including but not limited to burns, cuts, fires, and other injuries. You are responsible for maintaining a safe cooking environment. Furthermore, we do not guarantee that any Recipe will produce the desired or expected result. The outcome of a Recipe can be affected by numerous factors, including ingredient quality, equipment calibration, environmental conditions, and user skill. We are not responsible for failed dishes, wasted ingredients, or property damage.

4. Limitation of Liability & Indemnification

4.1 "AS IS" and "AS AVAILABLE" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

4.2 Comprehensive Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SAPIENT TECHNOLOGY GROUP LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR ITS FOUNDER, ERIK BENJAMINS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • (a) YOUR USE OF OR INABILITY TO USE THE SERVICE;
  • (b) ANY FOODBORNE ILLNESS, ALLERGIC REACTION, PERSONAL INJURY (INCLUDING CUTS, BURNS, OR FIRES), WRONGFUL DEATH, OR PROPERTY DAMAGE;
  • (c) ANY FAILED RECIPE, WASTED INGREDIENTS, OR DISAPPOINTING CULINARY RESULTS;
  • (d) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN;
  • (e) ANY ERRORS, INACCURACIES, OR OMISSIONS IN THE CONTENT.

4.3 Liability Cap

IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS, THE COMPANY IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS, OUR TOTAL CUMULATIVE LIABILITY SHALL IN NO EVENT EXCEED THE LESSER OF: (A) THE TOTAL FEES PAID BY YOU TO THE COMPANY FOR USE OF THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE DATE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

4.4 User Indemnification

You agree to defend, indemnify, and hold harmless Sapient Technology Group LLC, its founder, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) any claim that your use of a Recipe caused damage or injury to a third party.

5. Intellectual Property Rights

5.1 Our Ownership of Content

All right, title, and interest in and to the Service and its Content are and will remain the exclusive property of Sapient Technology Group LLC and its licensors. The Content is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our intellectual property includes, but is not limited to, the Kitchen Brigade architecture, all AI-generated Recipes, AI-generated images, software, text, branding, and logos. Using the Service does not grant you any ownership of our Content.

5.2 Your Limited License to Use Content

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Content for your Personal Use only, subject to these Terms.

5.3 Permitted and Prohibited Uses

Permitted Personal Use:

  • You may cook, print, and modify Recipes for your own non-commercial purposes.
  • You may share Recipes you have generated on your personal social media accounts or non-monetized personal blogs, provided that you include clear attribution: "Recipe generated by CulinaryAdvisor.ai" with a link back to our Service where possible.
  • Examples of acceptable Personal Use include: cooking for your family dinner, bringing a dish to a potluck, preparing food for a dinner party with friends, sharing a recipe with your book club, or teaching your children to cook using our recipes.

Prohibited Commercial Use:

  • You may not use the Content for any commercial purpose whatsoever without our prior written consent. Prohibited commercial uses include, but are not limited to:
    • Including Recipes on a monetized blog, website, or social media channel.
    • Publishing Recipes in a cookbook, e-book, or magazine.
    • Using Recipes in a restaurant, catering service, or any food-for-sale business.
    • Using Recipes to create a competing service.
    • Reselling or mass-distributing the Content.
    • Using Recipes in cooking classes where you charge attendees.
    • Including Recipes in meal planning services or subscription boxes.

5.4 Commercial Use Inquiries

If you wish to use our Content for any commercial purpose, you must obtain a separate commercial license. Please contact us at info@culinaryadvisor.ai to discuss your needs. Unauthorized commercial use is a violation of these Terms and an infringement of our intellectual property rights.

5.5 DMCA Compliance

We respect intellectual property rights and respond to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA). To report copyright infringement, please contact our designated agent at info@culinaryadvisor.ai with the following information:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
  • Your contact information (name, address, telephone number, and email address)
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

We will terminate the accounts of repeat infringers in appropriate circumstances. If you believe your content was wrongly removed, you may submit a counter-notification with the required information to the same address.

5.6 User-Shared Recipes

When you choose to share a Recipe publicly through our platform's sharing features, you grant us a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, display, and distribute that shared Recipe. This license allows us to:

  • Display your shared Recipe to other users on our platform
  • Include your shared Recipe in our public recipe collections
  • Feature your shared Recipe in marketing materials or blog posts (with attribution to your username)
  • Allow other users to save and use your shared Recipe for their Personal Use

You retain ownership of any personal notes, modifications, or creative additions you make to Recipes. Other users who access your shared Recipes must comply with these Terms, including the restrictions on commercial use. Shared Recipes may remain visible to other users even after you delete your Account.

6. User Accounts & Registration

6.1 Account Creation

To use certain features of the Service, you must register for an Account. You agree to provide accurate, current, and complete information during the registration process. You must be at least 13 years old to create an Account. By creating an Account, you affirm that you are at least 13 years of age. We may require age verification and will terminate accounts of users we reasonably believe are under 13. If you are between 13 and 17, you must have the permission of a parent or legal guardian, and they must agree to be bound by these Terms on your behalf.

6.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your Account. You must notify us immediately at info@culinaryadvisor.ai of any suspected unauthorized use of your Account. We are not liable for any loss or damage arising from your failure to comply with this security obligation.

6.3 Account Closure by You

You may close your Account at any time through your account settings or by contacting us. Upon cancellation of a paid subscription, your access to premium features will continue until the end of your current billing period. You must export any data you wish to save from your Recipe Library before your subscription period ends, as you will lose access to the Service thereafter.

6.4 Data Retention and Library Restoration

We handle different types of data according to the following retention schedule:

  • Recipe Library Data: Retained for 90 days after your subscription ends. If you re-subscribe within this period, your saved Recipe Library will be automatically restored.
  • Account Data: Basic account information retained per our Privacy Policy retention schedule.
  • Shared Recipes: May remain visible to other users even after Account deletion, as other users may have saved copies.
  • Deletion Rights: You may request immediate deletion of your personal data under GDPR/CCPA by contacting info@culinaryadvisor.ai. Note that we may need to retain certain information for legal compliance.

After 90 days, your Recipe Library data will be permanently deleted and cannot be recovered.

6.5 Account Termination by Us

We reserve the right to suspend or terminate your Account at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms. If we terminate your Account for cause, you will not be entitled to any refund.

7. Prohibited Uses & User Conduct

7.1 Prohibited Activities

As a condition of your use of the Service, you agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights.
  • Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate.
  • Interfere with the security-related features of the Service, including by disabling or circumventing features that prevent or limit use or copying of any content.
  • Reverse engineer, decompile, or otherwise attempt to discover the source code of the Service or its underlying architecture, including the Kitchen Brigade system.
  • Interfere with the operation of the Service or any user's enjoyment of the Service, including by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code.
  • Scrape or otherwise systematically collect data from the Service without our express written permission.
  • Access our Service through unauthorized APIs, bots, or automated tools without written permission.

7.2 Prohibited Content

You may not share or upload any content that:

  • Infringes any third party's copyrights or other rights (e.g., trademark, privacy rights, etc.).
  • Is sexually explicit or promotes a sexual act.
  • Is abusive, harassing, or promotes or condones violence.
  • Includes intentionally harmful or dangerous instructions, such as recipes with toxic ingredients or unsafe techniques.
  • Is fraudulent, false, misleading, or deceptive.

7.3 Enforcement

We reserve the right, but are not obligated, to monitor, screen, and edit user activity and content. We have the sole discretion to remove any content or suspend or terminate your Account at any time and for any reason, without notice. We are not responsible for any failure or delay in removing such content.

8. Subscription, Billing, and Payment Terms

8.1 Subscription Tiers

The Service offers both free and paid subscription options:

  • Free Tier: Includes limited access to recipe generation (up to 10 recipes per month), basic chat functionality, and the ability to save up to 25 recipes in your Personal Culinary Library.
  • Premium Tier: Includes unlimited recipe generation, advanced Kitchen Brigade features, unlimited recipe storage, recipe execution mode with timers, AI-generated images for all recipes, priority support, and early access to new features.

Detailed features and current pricing for each tier are available on our website's pricing page. We reserve the right to modify the features and pricing of any tier with 30 days' advance notice to existing subscribers.

8.2 Automatic Renewal

All paid Subscriptions will automatically renew at the end of the billing period (either monthly or annually) at the then-current price. You authorize us to charge your payment method on file for the renewal term. You are responsible for keeping your payment information up to date.

8.3 Cancellation

You may cancel your Subscription at any time through your Account settings. To avoid being charged for the next billing cycle, you must cancel before your renewal date. Upon cancellation, your access to premium features will continue until the end of your current paid billing period. We do not provide pro-rated refunds for cancellations.

8.4 Refund Policy

Monthly subscriptions: Non-refundable. Cancel anytime to stop the next bill.

Annual subscriptions: Refundable within 14 days of purchase. The refund is the annual price minus one month's rate at your original signup price ($69.90 − $6.99 = $62.91). After 14 days, annual subscriptions are non-refundable.

All plans: Cancel anytime via your account settings to stop future billing.

8.5 Price Changes

We may change the price of our Subscriptions from time to time. We will provide you with at least 30 days' advance notice of any price increase. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the new price.

9. Service Availability & Modifications

9.1 No Uptime Guarantee

The Service is provided on an "as is" and "as available" basis. We do not guarantee continuous, uninterrupted, or secure access to our Service. The operation of our Service may be interfered with by numerous factors outside of our control, including but not limited to, outages of our third-party service providers. We do not offer a service level agreement (SLA) for any tier of the Service.

9.2 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service, or any part thereof, at any time and without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

9.3 Third-Party Dependencies

The core functionality of CulinaryAdvisor.ai relies on third-party services, including Google Gemini for AI capabilities and Supabase for backend infrastructure. We are not responsible for any outages, changes, or failures of these third-party services. An interruption or change in these services may directly impact the availability and functionality of our Service.

9.4 Beta Features

We may offer Beta Features for testing and feedback purposes. Beta Features are provided "as is" without any warranties and may:

  • Not work as intended or contain bugs
  • Change significantly or be removed without notice
  • Be subject to additional terms when specified
  • Have limited availability or be invitation-only

You acknowledge that Beta Features are experimental in nature and you use them at your own risk. We appreciate but do not require your feedback on Beta Features. We may discontinue Beta Features or your access to them at any time without notice.

10. Privacy & Data Protection

10.1 Privacy Policy

Our Privacy Policy is incorporated by reference into these Terms. By using the Service, you agree to the collection and use of your information in accordance with our Privacy Policy. Please review it carefully to understand our data practices.

10.2 User-Uploaded Photos for Troubleshooting

If you use a feature that allows you to upload a photo for analysis or troubleshooting (e.g., to show a cooking result), that photo will only be used for the immediate purpose of providing a response within that specific conversation. These images are not stored long-term, are not used to train our AI models, and are deleted when the conversation expires or is deleted. You are responsible for ensuring you have the right to upload any image you provide.

10.3 International Users

The Service is operated from the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with your local laws. We make no representation that the Service is appropriate or available for use in locations outside the United States.

11. Third-Party Services & External Links

11.1 External Links

The Service may contain links to third-party websites or resources. We provide these links only as a convenience and are not responsible for the content, products, or services on or available from those websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources.

11.2 Affiliate Disclosure

Currently, CulinaryAdvisor.ai does not use affiliate links. However, we may do so in the future. If we recommend products or services and include an affiliate link, we will clearly disclose this to you at the time of the recommendation. We are committed to transparency and will only recommend products we believe provide value to our users.

12. Dispute Resolution & Governing Law

12.1 Governing Law

These Terms and any dispute arising out of or related to them will be governed by the laws of the State of Washington, without regard to its conflict of laws principles.

12.2 Informal Dispute Resolution

Before filing a formal claim, you agree to try to resolve the dispute informally by contacting us at info@culinaryadvisor.ai. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 60 days of submission, you or we may bring a formal proceeding.

12.3 Binding Arbitration

You and Sapient Technology Group LLC agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except as set forth under "Exceptions to Agreement to Arbitrate" below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in Spokane County, Washington, or any other location we agree to.

12.4 Class Action and Jury Trial Waiver

ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION OR OTHER REPRESENTATIVE PROCEEDING. YOU AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND THE COMPANY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

12.5 Exceptions to Agreement to Arbitrate

Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Service, or intellectual property infringement without first engaging in arbitration. Claims that qualify for small claims court may also be brought in small claims court in Spokane County, Washington.

13. General Legal Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire and exclusive understanding and agreement between you and the Company regarding the Service, and supersede and replace any and all prior oral or written understandings or agreements.

13.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null. We may freely assign or transfer these Terms without restriction.

13.5 Force Majeure

We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, natural disasters, acts of God, war, terrorism, civil unrest, government actions, pandemics, or labor disputes.

13.6 Survival

The following provisions shall survive any termination or expiration of these Terms: Section 3 (AI-Generated Content, Recipe Liability & Food Safety), Section 4 (Limitation of Liability & Indemnification), Section 5 (Intellectual Property Rights), Section 6.4 (Data Retention), Section 12 (Dispute Resolution & Governing Law), and this Section 13.6 (Survival), along with any other provisions that by their nature should survive termination.

14. Changes to These Terms

14.1 Right to Modify

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

14.2 Notice of Material Changes

If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Notice will be provided via email to the address associated with your Account or through a prominent notification within the Service.

14.3 Acceptance of Changes
